The vast, corporate-funded campaign to weaken unions and lower wages of middle-class workers has reached into statehouses all over the country.

Last week in Maine, Rep. Tom Winsor requested that so-called "right-to-work" bills be drafted. So did Sen. Lois Snowe-Mello. In New Hampshire, Rep. Will Smith proposed a "right-to-work" law. Similar bills were also proposed in Michigan, Indiana, Minnesota, Montana, West Virginia, and Missouri. I expect at least half a dozen more.
 
Working families need to fight like hell against these dangerous attacks on their wages, their benefits and their job security.
 
Research shows that most people don't know what these anti-union laws really do. That's intentional. You can be absolutely sure that a great deal of time and money was spent coming up with the misleading "right to work" name. It sounds like it prevents workers from being denied a job. That isn't what it does at all.
 
A so-called "right to work" law prohibits security clauses in union contracts. Security clauses require all workers who receive the benefit of a union contract and union representation to share the administrative costs for those services.
 
These "right to freeload" laws are on the books in low-wage states like Mississippi and South Carolina. That's not a coincidence. When union wages go down, workers' wages fall throughout the state.
 
A coordinated network of think tanks, business groups and phony grass-roots organizations has for years been working toward passing these right-to-work (for LESS) laws. Leading the charge is National Right to Work. The only right it defends is billionaires' right to their wealth. The anti-worker group attracts funding from the Mellon heirs, the Wal-Mart heirs and the Coors heirs.
 
Right-to-work bills are political payback for campaign contributions by corporations and billionaires. They are supported by false claims that they create jobs. What they have done in the states where they've been enacted is lower wages by an average of $5,333 a year. In right-to-work states:
 
Fewer people have health insurance and the taxpayers pay substantially more to support the state's Medicaid program.
•The poverty rate rises; it's 19.1 percent in right-to-work states, compared with 16.6 percent in other states.
Don't be fooled by the misleading propaganda created by billionaires and corporations for the politicians they've purchased. These proposals have nothing to do with the right to work. They're all about forcing people to work for less.

FedEx’s lobbying offensive and CEO Fred Smith’s political clout translate into big dollars for the UPS competitor, and these numbers show exactly why FedEx launched a multi-million dollar lobbying offensive to thwart the legislation that would level the playing field in the package industry. 

By doing everything in its power to remain nonunion, FedEx Express maintains a stronghold over its employees and a clear competitive advantage over UPS. 
 
The numbers breaking down average wages at the two companies show that the average full-time package driver at UPS makes nearly $18 dollars an hour more including wages and benefits than the person doing the same job at FedEx Express. 
 
A contract makes all the difference for inside part-time workers at UPS as well, who make over $12 dollars an hour more than their FedEx counterparts when health and welfare and pension contributions are factored in. Part-timers at FedEx have no pension and must pay all of their own health care costs. 
 
FedEx will stop at nothing to keep its employees from enjoying the benefits of a union contract regardless of which sector of FedEx they work in. FedEx continues to mis-classify its Ground and Home Delivery work force as “independent contractors” in order to avoid thousands of dollars per driver in wages and benefit contributions, not to mention other costs such as payroll taxes, vehicle maintenance costs and unemployment insurance. Dec. 20th, 2010- FAA Bill Extended Again 

Several disputes have stalled the long-term reauthorization bill (HR 915), including a proposal that would make it easier for FedEx package workers to unionize by placing them under the same labor laws as UPS. House Republicans are not likely to draft an FAA reauthorization with that language in the next Congress.

July 21, 2010- FedEx Spends Millions to Protect Its Special Corporate Loophole
FedEx Corp., trying to defeat legislation that would make it easier for its employees to unionize, almost doubled its lobbying spending in the first six months of this year compared with the same period a year ago.

"Right-to-Work" For Less

Right-to-work for less doesn’t guarantee any rights. In fact, by weakening unions and collective bargaining, it destroys the best job security protection that exists: the union contract. Meanwhile, it allows workers to pay nothing and get all the benefits of union membership. Right to work laws say unions must represent all eligible employees, whether they pay dues or not. This forces unions to use their time and members’ dues money to provide union benefits to free riders who are not willing to pay their fair share.

Right to work laws lower wages for everyone. The average worker in a right to work state makes about $5,333 a year less than workers in other states ($35,500 compared with $30,167).[1] Weekly wages are $72 greater in free-bargaining states than in right to work states ($621 versus $549).[2] Working families in states without right to work laws have higher wages and benefit from healthier tax bases that improve their quality of life.
 
Federal law already protects workers who don’t want to join a union to get or keep their jobs. Supporters claim right to work laws protect employees from being forced to join unions. Don’t be fooled—federal law already does this, as well as protecting nonmembers from paying for union activities that violate their religious or political beliefs. This individual freedom argument is a sham.
 
Right to work endangers safety and health standards that protect workers on the job by weakening unions that help to ensure worker safety by fighting for tougher safety rules. According to the federal Bureau of Labor Statistics, the rate of workplace deaths is 51 percent higher in states with right to work, where unions can’t speak up on behalf of workers.[3]
 
Right to work laws just aren’t fair to dues-paying members. If a nonunion worker is fired illegally, the union must use its time and money to defend him or her, even if that requires going through a costly legal process. Everyone benefits, so all should share in the process. Nonmembers can even sue the union if they think it has not represented them well enough.

Teamster Freight Members Ratify YRCW Restructuring Plan

 
Agreement Is Aimed at Saving More Than 25,000 Jobs

(Washington, D.C.) – Teamster members who work at YRC Worldwide Inc.’s (YRCW) operating companies YRC, Holland and New Penn have ratified the “Restructuring Plan” that is aimed at saving more than 25,000 union jobs. YRC and Holland members ratified the agreement by a 62 percent to 38 percent margin, while members at New Penn ratified the agreement by a 69 to 31 percent margin. About 67 percent of YRCW Teamsters cast ballots.

The ratified Restructuring Plan is the product of months of discussions and difficult negotiations by the Teamsters National Freight Industry Negotiating Committee (TNFINC) in consultation with Teamster local unions. On September 29, leaders from Teamster freight local unions unanimously recommended to send the plan to a membership vote. Union members voted by mail over the past three weeks and ballots were counted this weekend.

“We realize that in ratifying this Restructuring Plan our members will continue to make huge sacrifices, which have been very difficult for our members and their families during the worst economic recession in decades,” said Tyson Johnson, Director of the Teamsters National Freight Division. “However, we firmly believe this plan is the only hope for saving our members’ jobs as this recession continues to cause so much hardship.”

“As painful as the sacrifices are on an individual level, our members understood that by approving this Restructuring Plan they would be setting the stage for the company’s existing lenders to do their part and make this company an attractive investment for new investors and preserve their jobs,” Teamsters General President Jim Hoffa said. “As this restructuring moves forward over the next three to six months, the union will be involved every step of the way.”

During negotiations with the company, the union received input from a team of experienced, respected and independent financial and restructuring experts it assembled over the past year to verify the company’s financial situation and to assist in developing this restructuring plan. Through this lengthy and ongoing process, the union has reviewed numerous financial and operational reports on YRCW and determined that this Restructuring Plan is the only avenue to save and hopefully grow the respective companies it operates.

The Restructuring Plan modifies and extends the current National Master Freight Agreement (NMFA) and Supplemental Agreements for a two-year period until March 31, 2015 and provides for annual wage and benefit increases including a resumption of partial pension contributions beginning in June 2011.

In addition to participating in the debt reduction and equity investment discussions to create a sustainable company, the union will require equity ownership of the company and, at a minimum, one additional board seat. The plan also calls for continued equal sacrifice—management and non-union employees are required to participate in cost sharing in an equal manner. The plan has additional compensation improvements for Teamster members based on the company’s future operating performance.

Local 492 held 2 meetings at the hall on Tuesday August 17th, 2010, for anyone who had questions regarding their health care plans.  Representatives from Southwest administrators, Presbyterian, and Lovelace were available to answer questions.

The May SIDS Benefit Was A Success!

     

 

Teamsters Local 492 was proud to sponsor the Riley/Ryken SIDS Benefits. The Golf and Softball Entry deadlines have passed. Below is an Update on the success of the benefit:

As some of you may know, Johnny lost a Granddaughter to SIDS in 2002, and a close family friend of Johnny’s also lost their son to SIDS in 2005. In 2006, a family friend started a softball tournament in support of SIDS. Johnny’s family is now involved in 3 projects under the Riley/Ryken SIDS Fundraiser name. They had their 21 foot 2010 Travel Trailer on site at the Roadeo, and it was raffled off on May 15th. They sold lots of tickets and the raffle was a big success helping raise money for SIDS.

"We would like to say a great big Thank you to the Teamsters Local 492 for all that they did to help us be successful in our Riley/Ryken S.I.D.S. awareness raffle drive and to all the employees that were so kind and generous. The winner was an ABF employee, Robert Aragon, he bought his ticket at the Truck Driving Championships. Congratulations Robert! Enjoy the camper; a lot of people wanted it!

 I want to say a very special Thank you to the ladies in the Local 492 office, Carol Reynolds and Darlene Archuleta, they did an awesome job selling tickets for us during their busy days, we can't say Thank you enough! ABF Freight Teamsters Reject Plan to Protect Jobs, Benefits
 

Teamsters employed at ABF Freight System have rejected a Wage Reduction-Job Security plan aimed at protecting the jobs of more than 7,000 workers and securing their health, welfare and pension benefits for the remainder of the National Master Freight Agreement.

Mail ballots were sent out April 30 and counted today with the process being overseen by an independent election officer. With a final count of 3764 no, 2936 yes, (a difference of 828 votes, out of 6700) the workers voted no on the plan with about 80 percent of the members affected participating in the vote.

We took a proactive approach to help ABF get through the worst economic recession since the Great Depression, but our members have rejected the plan,” said Tyson Johnson, Director of the Teamsters National Freight Division. “The union will regroup to determine if there are other means to protect jobs and benefits. Our first priority continues to be the members’ best interests.”

Ballots were sent out to about 7,000 active employees and about 1,000 workers with recall rights. About 56% of the  6,700 employees that cast ballots, voted no.

"The current economic decline has been unprecedented in its depth and duration.  Our company, including our nonunion employees, has made significant financial sacrifices during this period.  It is unfortunate that our union employees have chosen not to participate in better aligning ABF's cost structure with those of its LTL competitors," said Judy R. McReynolds, Arkansas Best President and Chief Executive Officer.  "Going forward, we will evaluate our various options in dealing

"We’ve been officially notified that the proposed Wage Reduction-Job Security Plan failed to receive the necessary majority of votes for its passage which I deeply regret. This means we'll be forced to pursue other less desirable and less palatable solutions that will in all likelihood be more short-termed focused than the more preferable long term. That said, we certainly don't intend to give up. However, we need everyone to step up and render unprecedented effort in performing your jobs. I remind you that a 15% improvement in productivity can deliver essentially the same benefit to the company as a 15% wage cut. Consequently, I urge you to go about your duties as the professionals you are and strive to perform every task as promptly, precisely, cooperatively, and safely as possible."
